Mr Justice Wilson denied the child protection claims but added that it was wrong to give a child the same treatment as the mentally ill by treating him like a criminal and punishing him for actions that he did not commit. Mr Justice Wilson made reference to the case of a child in the same predicament, that of a boy who had been found not guilty by reason of mental defect in 2013. He said it was the wrong precedent in light of the recent child abuse case where two children, both mentally ill, were moved into homes for a period of time and then later sent away on extended periods of time so that they might get better treatments. Mr Justice Wilson found that the accused in that case should have been allowed to remain on the remand without being placed under the full risk of becoming violent or dangerous as is now seen here.

The judge said the accused had been properly protected but the fact that he now had to live in a state of indefinite residential protection meant he should have been moved to a group home. "In this case the group home is a reasonable accommodation, which is not, for example, a home to children with mental impairments," Mr Justice Wilson wrote. "In that sense, it does not appear that this group home is a safe place for the accused." On a separate subject, the court also upheld the case of a 16-year-old boy who was thrown off a Sydney bus and hit by a car while walking on the city's main train route this morning.

A day earlier the court had ordered that the boy be taken home to a place where he could be properly cared for, after the youth was allegedly punched, pushed and hit by a stranger on the train this morning. The judge in the case noted that the child had previously been taken into care but after a few months his carer returned him to the system. The boy was then taken back to the home of another child when he had been deemed not to be dangerous.

When questioned after the court hearing about the situation, Mr Justice Wilson said they had no choice but to allow the boy's mothe
